    1. Introduction

    These Terms and Conditions ("Terms") along with our privacy notice and disclaimer, available at www.golddigitalmarketing.com (the "Website"), set out the basis on which we provide access to our Website and the provision of any Services to you. When you access, visit, or use our Website or purchase any of our Services you agree to be bound by them.

    If you purchase a particular coaching programme or other bespoke service, you may be asked to agree to separate terms specific to that product or service. Where a conflict arises, those separate terms will take priority over these Terms.

    These Terms comply with the Digital Markets, Competition and Consumers Act 2024 ("DMCC Act") and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

    2. Accessing our Website

    Our Website is intended for individuals over the age of 18. Access is provided free of charge on an 'as available' basis, and we shall not be liable if you're unable to use or access it for any reason. We are committed to making our Website accessible to all users in accordance with the Equality Act 2010.

    3. The Services

    We provide business and personal development support through online and self-study courses, workshops, and coaching and mentoring sessions and programmes ("the Services"). Further details can be found on our Website and social media channels.

    4. What you agree when you purchase our Services

    When you purchase any Service, you confirm that you are over 18, legally capable of entering into a binding contract, and that all information you provide is true and accurate. You agree to keep your access private and not to share, disclose, assign, sell, or licence any part of it.

    You acknowledge that the Services are designed to provide information, materials, and support and are not a substitute for counselling or other therapy services. Decisions and actions arising from the Services remain your sole responsibility.

    5. One-to-one sessions

    Where a Service includes a one-to-one session, the schedule will be agreed with you, and you are responsible for attending fully and on time. Sessions take place via Zoom or another online meeting facility. You may cancel or reschedule up to 48 hours before the start time; failure to do so may result in forfeiture of the session or a £150 cancellation fee. If we are waiting more than 15 minutes from the start time, we may treat you as a no-show.

    6. Group sessions

    Where the Service includes group calls or meetings ("Sessions"), we will deliver them by online meeting facility or telephone and confirm the date and time by email. No replacement dates will be offered if you are unable to attend.

    7. Your responsibility to others

    You agree to conduct yourself in a reasonable and responsible manner at all times when accessing our Services and not to act in a way that may cause offence, distress, or alarm to others. You must not use access for unlawful purposes, record any part of a Session for personal use, capture or share images of others without their consent, or post defamatory, obscene, threatening, or harassing content. We may exclude you from any group or Session in the event of disruptive behaviour.

    8. Your purchase of our Services

    Your purchase is a contractual offer that we may choose to accept; our agreement begins when we send our welcome email. If your order is not accepted, we will notify you and provide a full refund. Where digital content is available immediately, you will be asked to consent to immediate access and acknowledge that you waive your 14-day cancellation right.

    9. Payment and charges

    The purchase price ("the Fee") is set out on the checkout page. Payment is due before access is granted. If you pay by card, you authorise us to charge your payment method. If we agree to instalments, you agree to set up a direct debit or similar arrangement and remain responsible for instalments until the Fee is paid in full. We reserve the right to change our Fee at any time; changes will not affect Services already paid for.

    10. Late payment

    Where payment is more than 7 days overdue we may withhold delivery of Services, add interest at 8% over the Bank of England's base rate, withdraw any discount, and after 30 days instruct a collection or legal agent.

    11. Your right to cancel and refund policy

    14-day cooling-off period. If you purchase Services online or by other distance selling methods, you have a legal right to cancel within 14 days under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. The period begins the day after we send our welcome email.

    To cancel, send a clear written statement to support@golddigitalmarketing.com. If you cancel within the cooling-off period and the service has not yet started, you will receive a full refund within 14 days.

    Early commencement. If you ask us to begin during the cooling-off period, you must consent in writing and you will be required to pay a proportionate amount for services provided up to cancellation. If the service is fully performed before the 14 days end, you lose the right to cancel.

    Digital content. If your purchase includes downloadable courses, videos, or materials, you will be asked to expressly waive your 14-day cancellation right on first access.

    After the cooling-off period. No refunds will be provided except where a fault is found to exist with the Service. In such cases, contact us immediately and we shall use our best endeavours to remedy the fault.

    Chargebacks. Please raise concerns with us before pursuing a chargeback. Failure to contact us first may result in you being responsible for any administrative costs we incur.

    12. Cancellation and termination

    You may cancel your access to any Service by notice by email. We reserve the right to terminate immediately if you commit a material breach of these Terms, fail to pay any sum due, act in a way detrimental to our business or reputation, or fail to engage positively with the Services.

    13. Complaints or concerns

    If you have any concerns, please email support@golddigitalmarketing.com and give us a reasonable opportunity to investigate before taking further action.

    14. Confidentiality

    We will not communicate or disclose Confidential Information you share with us, or use it for our own purposes, without your consent. You agree to do the same in respect of Confidential Information disclosed by us or by other participants.

    15. Our intellectual property

    When you purchase Services we grant you a personal, limited, non-transferable, non-exclusive, revocable licence to access and use the Content for the intended purposes only. You agree not to copy, reproduce, sell, licence, share, or distribute any Content, or to record any of our webinars, events, videos, or Sessions.

    16. Your personal data

    Any Personal Data you provide will be processed in accordance with the UK GDPR and the Data Protection Act 2018. Full details are in our privacy notice. As part of the Services your image may be recorded in photographs or screenshots; you may revoke consent by emailing us.

    17. Acceptable use

    You may only use our Website and social media channels in a way that is lawful and in accordance with these Terms. You may view the Website, download free resources marked suitable for download, and post where permitted, provided you are at least 18.

    18. Reviews and testimonials

    If you share testimonials, reviews, comments, or images, you grant us permission to exhibit, copy, publish, and use that content to promote our business. You confirm you have the legal right to share it.

    19. Non-solicitation

    For the duration of your access to the Services and for 12 months afterwards, you agree not to canvass, promote, or advertise your products or services to any of our employees, contractors, clients, or prospective clients without our written consent.

    20. Liability

    We shall not be liable for indirect, consequential, or special damages, loss of profits, business, data, reputation, or goodwill. Our entire liability is limited to the amount of the relevant Fee paid by you. Nothing in these Terms limits liability for death or personal injury caused by our negligence, for fraudulent misrepresentation, or your statutory rights under the Consumer Rights Act 2015.

    The Website is provided 'as is' and 'as available'. We are not responsible for third-party websites linked from ours. In the event of a dispute we will both submit the matter to mediation before commencing legal action.

    21. No guarantee

    Your success and results depend on factors outside our control, and we cannot guarantee any particular results. Testimonials and examples are not intended to guarantee the same results.

    23. Updates or changes

    We reserve the right to make changes to these Terms at any time and will display a notice of any changes on our Website. Your first use of our Website after changes will constitute acceptance.

    24. General

    No failure to enforce any provision shall constitute a waiver. If any part of these Terms is invalid, the remainder will remain in force. We are not liable for delays caused by events beyond our reasonable control. This Agreement is governed by the laws of England and Wales.
